1. Acceptance of Terms

By accessing or using MementoHub (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

MementoHub provides a persistent memory system for AI coding agents. The Service allows users to store, search, sync, and manage observations, decisions, discoveries, and other data ("Mementos") across coding sessions, projects, and collaborators via local storage, cloud synchronization, and MCP protocol integration.

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify MementoHub of any unauthorized use of your account. MementoHub cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

4. Plans and Billing

MementoHub offers both free and paid plans. Paid plans provide access to additional features, including advanced security layers such as enhanced encryption. Plan pricing and features are described on our website and may be updated from time to time. Payments are processed through our third-party payment providers. Subscription renewals are automatic unless cancelled before the renewal date.

5. Security

MementoHub implements industry-standard security measures to protect your data. However, no method of transmission over the Internet or electronic storage is 100% secure.

Advanced encryption and additional security layers (e.g., end-to-end encryption, advanced at-rest encryption) are available only on paid plans.

6. Backup and User Responsibility

Users are strongly encouraged to maintain independent backups of their information. MementoHub is not a primary storage service and does not guarantee full data recovery in the event of incidents. You are solely responsible for ensuring you have adequate backups of any data stored in the Service.

7. Intellectual Property

You retain all intellectual property rights to the content you create and store using the Service. MementoHub does not claim ownership over your Mementos, observations, or any other content you produce. MementoHub retains all rights to the Service itself, including its software, design, and branding.

8. Acceptable Use

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. You agree not to attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems connected to the Service. MementoHub reserves the right to terminate accounts that violate these terms.

9. Limitation of Liability

To the fullest extent permitted by applicable law, MementoHub and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or data breaches, arising from your use of or inability to use the Service.

10. Modifications

MementoHub reserves the right to modify these Terms at any time. We will notify users of significant changes via email or through a notice on the Service. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through your account settings.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which MementoHub operates, without regard to its conflict of law provisions.
